Phase I ESA
E2 ManageTech prepares Phase I ESAs in accordance with the American Society for Testing and Materials (ASTM) Standard Practice for Environmental Site Assessments: Phase I Environmental Site Assessment Process, Designation E 1527-05, and the Federal All Appropriate Inquiry (AAI) rule (40 CFR Part 312 – Standards and Practices for All Appropriate Inquiries). E2 investigates readily observable conditions existing at a property, and identifies any recognized environmental conditions (RECs) in connection with the property.

Site investigations are often based on the information gathered for and recommendations provided in a Phase I Environmental Site Assessment (ESA) or recent chemical release information. E2 ManageTech (E2 ) has successfully designed and completed numerous subsurface multi-media site investigations for our clients. Projects have been completed in conjunction with capital improvements, redevelopment projects, litigation support, emergency response, on-going construction activities, and property acquisition activities. This experience and technical expertise is applied at all client sites to provide valuable service to meet our client’s challenges while maintaining our mutual priorities of health and safety, schedule management and delivering the highest quality data.
E2 ’s strategy for site investigation activities guides our clients through a course of action that satisfies the requirement of the responsible regulatory agency while maintaining a balance between the goals of minimizing cost and moving forward in a timely manner. While compliance with the regulatory requirements will always be a priority, we also understand that environmental investigation and cleanup activities can be driven by extenuating circumstances including construction or development schedules. E2 will utilize our experience to implement proven strategies to complete necessary environmental actions while meeting the regulatory requirements and minimizing/eliminating impacts to pending construction/development schedules.
E2 approaches a Phase II site investigation project in the following sequence:
1. Meet with the client to clearly identify project goals and objectives including: schedule, cost, site access, regulatory needs, etc. (e.g., front loaded collaboration).
2. Review potential chemicals of concern, relevant regulatory issues, and related case studies and jointly develop a strategy for achieving objectives within time and cost limits, and refine the strategies as necessary (e.g., ground truthing).
3. Review project plan and identify key approvals and necessary permits.
4. Prepare a work plan that specifies the technical work assignments, staffing, project deliverables, key milestones, and budgets on tasks.
5. Develop a Quality Assurance Plan for larger job tasks to guide the project team, including analytical laboratories.
6. Conduct a project kick-off meeting with the project team management and the client point of contact.
7. Execute the work plan in a timely and cost-efficient manner.
8. Conduct periodic client review to ensure that the project is on track and the work product prepared is accurate, complete, and acceptable before the final document is submitted

E2 has become a leader in assisting governmental agencies with redevelopment projects including Brownfield redevelopment, new school construction, and roadway/facility expansion projects. Our experiences and expertise cover a full range of services that include: preparing grant applications, managing Brownfield grant programs, coordinating and developing community outreach activities, conducting area-wide inventories, preparing Phase I Environmental Site Assessments (ESAs), implementing Phase II Site Investigations, conducting project feasibility studies, planning and executing remediation alternatives (including green remediation), coordinating regulatory involvement to obtain Site Closure, and California Environmental Quality Act compliance. E2 has provided these services to city and local redevelopment agencies, school districts, developers, federal and state regulatory agencies, and private land owners.
We understand the interrelations between the various project drivers and how these various drivers can impact a project’s budget and schedule. Because Brownfield and property redevelopment projects typically have multiple stakeholders, project communication is paramount to keeping a project on schedule and within budget. Thus, we implement multiple means and methods to continually keep the stakeholders updated and informed. Depending upon the demographic characteristics of the project location, we may utilize standard communication methods such as bulk mailers, community meetings, newspaper publications, and/or participating in regular Board/Council meetings. Other successful communication methods that we have implemented include email announcements, Internet web pages, neighborhood gatherings/workshops, and places of worship announcements.
Other challenges associated with conducting Brownfield and property redevelopment projects include site access. In most instances, it is preferred to obtain voluntary permission from the property owner or tenant to access the site for conducing a Phase I ESA or other site investigation activities. In other instances, it may be necessary to acquire site access via the Polanco Redevelopment Act or court ordered action. E2 has directly negotiated voluntary site access agreements from hundreds of property owners. We have also assisted our clients with obtaining sites via the Polanco Act and court ordered actions.
To ensure that our ESAs and/or investigations achieve the data quality objectives of the regulatory oversight agency, we assist our clients with preparing and negotiating regulatory oversight agreements. After the oversight agreements are established, we work closely with the oversight agency while developing our site assessment/investigation strategies, preparing work planning documents, implementing field activities, interpreting site data, and providing recommendations that are protective of human health and/or the environment.

Our capabilities in site assessment and remediation, regulatory compliance, information management, and risk assessment, combine to create uniquely customized solutions to support attorneys, developers, property owners, investors, industrial facilities, and others in assessing liability associated with current operations, past releases and/or environmental property conditions, to manage, interpret and visualize environmental quality data effectively, and to negotiate settlement or regulatory agency closure. E2 ManageTech has experience providing testifying and non-testifying expert witness support, and in critiquing an opposing side’s position relative to the National Contigency Plan, standard of practice and scientific merit. E2 ManageTech has worked with attorneys representing a variety of clients through business and land transactions, permitting with regulatory agencies, and with compliance issues, and has provided support during mediation, and expert testimony during deposition and trial phases.
